Broken out of box and they want to charge me to exchange

Bought a NEW phone. Opened the package and tried to charge it, defective. They want to charge me $55 to replace it. The first phone was suppose to be brand new and not broken! Why should I be charged to replace a phone when I never received what I was promised, a new working phone. I have been with this company for many years, but this is the last straw.
